Terms of Service

Effective date: 1 March 2026

These Terms of Service ("Terms") govern your access to and use of NaviShare, a boat co-ownership management platform operated by MCD ("we", "us", or "our"), a company based in Spain. By creating an account or using NaviShare you agree to these Terms. If you do not agree, do not use the service.

1. The Service

NaviShare is a software-as-a-service platform that allows co-owners of boats to manage bookings, expenses, maintenance, documents, and communication. The service is currently provided in a beta phase, free of charge. We reserve the right to introduce paid plans in the future with reasonable advance notice.

2. Beta Notice

The service is currently in beta. This means:

• Features may change, be added, or be removed without prior notice.
• We do not guarantee uptime or a specific level of availability.
• In exceptional circumstances, data may be reset or migrated during the beta period. We will give advance notice wherever possible.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must notify us immediately at navishare@navishare.io if you suspect unauthorised access.

You must be at least 18 years old to use NaviShare.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable law.
• Upload content that is defamatory, fraudulent, or infringes third-party rights.
• Attempt to gain unauthorised access to other users' data.
• Reverse-engineer, copy, or resell any part of the service.
• Use the service to send unsolicited commercial communications.

5. Your Data

You retain ownership of all data you input into NaviShare (boat details, expenses, bookings, documents, etc.). By using the service, you grant us a limited licence to store and process that data solely for the purpose of providing the service to you. We do not sell your data.

You can request a copy of your data or request deletion at any time by contacting us at navishare@navishare.io.

6. Intellectual Property

The NaviShare platform, including its design, code, and content (excluding user-submitted data), is the property of MCD. Nothing in these Terms grants you any right to use our trademarks or branding.

7. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. NaviShare is a management tool — it does not provide legal, financial, or nautical advice.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MCD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. Our total aggregate liability shall not exceed the amount you have paid us in the twelve months preceding the claim (or €0 during the free beta period).

9. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access at any time if you breach these Terms or if we decide to discontinue the service, with reasonable notice where practicable.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
